These Terms of Use set forth the common terms and conditions for all applications and related services (hereinafter collectively referred to as the "Services") provided by JM Apps.

Article 1 (Purpose)

These Terms of Use (hereinafter referred to as the "Terms") set forth the conditions for using all smartphone applications and related services (hereinafter collectively referred to as the "Services") provided by JM Apps (hereinafter referred to as the "Provider").

Article 2 (Definitions)

  1. "User" refers to any individual or corporation that uses the Services upon agreeing to these Terms.
  2. "Services" refers to all applications developed and provided by the Provider and all services related thereto.
  3. "Paid Services" refers to features and content provided within the Services that become available upon payment of fees by the User.
  4. "Content" refers to data, images, text, and any other information provided through the Services.
  5. "Intellectual Property Rights" refers to copyrights, patent rights, trademark rights, design rights, and other intellectual property rights.

Article 3 (Agreement to these Terms)

  1. By using the Services, the User is deemed to have agreed to all provisions of these Terms.
  2. If the User is a minor, the User must obtain the consent of a person with parental authority or other legal representative before using the Services.
  3. The Provider may change these Terms in the event of changes in laws and regulations, changes in the content of the Services, or other reasonable necessity. The revised Terms will be posted on this website or within the Services, and will apply from the effective date separately specified at the time of posting. If the User continues to use the Services after the change, the User is deemed to have agreed to the revised Terms.

Article 4 (Use of the Services)

  1. The User shall comply with these Terms and laws and regulations, and use the Services lawfully and appropriately.
  2. When using the Services, the User must not engage in the following acts:
    1. Acts that infringe upon the Intellectual Property Rights, portrait rights, privacy, honor, or other rights or interests of the Provider, other Users, or third parties.
    2. Acts that violate public order and morals, or acts that provide information violating public order and morals.
    3. Acts related to criminal behavior or acts that promote crime.
    4. Acts that cause damage to the Provider, other Users, or third parties.
    5. Acts that may interfere with the operation of the Services.
    6. Acts of providing false information.
    7. Acts that exploit bugs or vulnerabilities of the Services.
    8. Acts of reverse engineering, decompiling, or disassembling the Services.
    9. Acts of attempting to obtain the source code of the Services.
    10. Any other acts that the Provider deems inappropriate.
  3. If the User violates these Terms, the Provider may temporarily or permanently suspend their use of the Services.

Article 5 (Paid Services)

  1. Some features and content of the Services are provided as Paid Services. Payment of separately specified fees is required to use Paid Services.
  2. The fees, payment methods, and provision periods for Paid Services shall be displayed within the Services or on a separately established fee schedule.
  3. The User shall pay the fees for Paid Services by the method designated by the Provider.
  4. The Provider may revise the fees for Paid Services without the prior consent of the User. In the event of a fee revision, the Provider shall notify the User in advance.
  5. Even in the event of cancellation of Paid Services due to the User's circumstances or suspension of use midway through the usage period, the Provider shall not issue refunds. However, this does not apply if a refund is required by law or if a refund is permitted based on the policies of payment platforms such as Apple / Google Play.
  6. The Provider may change or terminate the content of Paid Services if there is a reasonable necessity. In such cases, the Provider shall inform Users in advance on this website or within the Services, except in emergencies.
  7. Usage fees for Paid Services will be billed via the User's Apple ID (or Google Play account).

Article 6 (Intellectual Property Rights)

  1. Intellectual Property Rights concerning the Services and the Content provided belong to the Provider or third parties holding legitimate rights.
  2. Users may not reproduce, modify, distribute, publicly transmit, or engage in any secondary use of the Content without the Provider's permission.
  3. The copyright of information provided by Users through posting, uploading, etc., belongs to the respective User, but the Provider may use it free of charge within the scope necessary for the operation of the Services.

Article 7 (Personal Information)

  1. The Provider shall appropriately handle Users' personal information based on the separately established Privacy Policy.
  2. Upon using the Services, the User agrees to review and consent to the contents of the Provider's Privacy Policy.

Article 8 (Advertisements and External Services)

  1. The Services may display advertisements by utilizing ad delivery services provided by third parties.
  2. The information acquired in connection with the display of advertisements and the handling thereof shall be subject to the Provider's Privacy Policy and the policies set by the respective third parties.
  3. The Provider does not guarantee the content, quality, safety, accuracy, etc., of the advertisements or the linked destinations of the advertisements.

Article 9 (Disclaimers)

  1. The Provider does not guarantee that the Services are fit for the User's specific purpose, nor does it guarantee commercial usefulness, completeness, accuracy, usefulness, currency, or safety.
  2. The Provider may alter, suspend, stop, or terminate all or part of the Services due to maintenance, specification changes, system failures, communication line defects, natural disasters, or other reasons.
  3. Users are responsible for dealing with advertisements, external linked services, or transactions/disputes with third parties, and the Provider does not guarantee or involve itself in these matters.
  4. Except in cases of willful misconduct or gross negligence by the Provider, the Provider shall not be liable for any damages incurred by the User resulting from the use or inability to use the Services, or the alteration, suspension, stoppage, or termination of the Services.
  5. Notwithstanding the preceding paragraph, even if the Provider is liable, its liability shall be limited to the scope of ordinary and direct damages actually incurred by the User.

Article 10 (Changes to these Terms)

  1. The Provider may change these Terms in the event of changes in laws and regulations, changes in the content of the Services, or other reasonable necessity. The revised Terms will be posted on this website or within the Services, and will apply from the effective date separately specified at the time of posting.
  2. If the User continues to use the Services after the revision of these Terms, the User shall be deemed to have agreed to the revised Terms.

Article 11 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms shall be governed by the laws of Japan.
  2. In the event of a dispute arising in connection with the Services, the district court having jurisdiction over the location of the Provider's address shall be the exclusive agreement jurisdictional court of the first instance.
